When thinking about moving to Spain and specially when considering incorporating a company, you must know that from de moment you start to develop any lucrative activity in Spain, you will be bound to pay taxes. For this reason, you shall issue a Tax Identification Number or NIF (“Número de Identificación Fiscal” in Spanish).
In order to comply with your fiscal duties and develop an economic activity you shall have the aforementioned tax identification number, whether you are a Spanish citizen, legal resident or foreigner. Normally, the NIF of a Spaniard is his/her DNI (“Número de identificación” in Spanish) plus a capital letter. If a non-Spanish national wish to issue his/her NIF, he or she will need her NIE (“Número de indentificación de extranjero” in Spanish) first.
The Tax identification number is generally issued in the corresponding Spanish Tax Office or “Agencia Tributaria” in Spanish, as this number will be generally required when fulfilling any legal procedure or duty of taxable nature before the abovementioned Spanish Administration.
When will I be requested a Tax identification number?
Generally, you will be requested to show your NIF in any of the following situations:
If you have been selected director or manager of a Company located in Spanish territory.
If you are joining or taking part of a partnership or venture in a Spanish Company.
If you are claiming an inheritance in Spain in order to pay the corresponding taxes of it.
If you will be developing a lucrative activity as a self-employed.
If you are setting up a company in Spain.
What do you need to do to issue your NIF?
As a foreigner if you are planning to open a bank account, buy a car, property or set up a company in Spain, you must know that you will be bound to pay taxes, thus you shall activate your NIE before the Tax Office by completing and presenting the corresponding documentation upon requesting the necessary appointment. Once you have gone to the Tax Office and done the procedure, they will give you a certificate with your NIF.
Also, you must consider that all the Spanish Administrative officers speak Spanish and the documents to be filled out and submitted are in Spanish language as well; therefore, if you need to issue your NIF and your Spanish level is not fluent, you may find this task difficult to fulfill. As a bilingual Law Firm, our purpose is to help you dealing with these procedures on your behalf, saving you time, money and dealing with the administration.
